This Privacy Policy explains how BCA Attendance Solutions LLC, doing business as School Attendance Solutions ("we," "us," or "our"), collects, uses, shares and protects information through our website, schoolattendancesolutions.com, the PresenceIQ™ attendance intervention platform, the PresenceIQ Parent Portal, and our text messaging program (together, the "Services").
1. Who we serve
PresenceIQ is used by schools and school districts ("Schools") to understand why students miss school and to reach families with the right support. We provide the Services to Schools under a written agreement. When we handle student or family information on a School's behalf, the School controls that information and we process it only as the School directs.
2. Information we collect
Information Schools provide to us
- Student information needed for attendance work, such as name, school, grade, student ID, and attendance records.
- Parent and guardian contact information, such as name, phone number, email address and preferred language.
- School staff account information, such as name, role, school, and work email.
Information parents and guardians provide
- Name, mobile phone number, email address and language preference entered in the Parent Portal or enrollment forms.
- Your consent to receive text messages, including the date, time and method of consent.
- Messages, replies and absence reasons you send through the Parent Portal or by text.
Information from website visitors
- Details you submit through our contact or demo request forms, such as name, email, role and organization.
- Basic technical information, such as browser type, device type, pages viewed and IP address, collected through standard server logs.
3. How we use information
- To provide PresenceIQ to Schools, including attendance insights, family outreach and intervention tracking.
- To send attendance and account notifications to parents and guardians who have opted in.
- To respond to questions, demo requests and support requests.
- To maintain, secure and improve the Services.
- To comply with the law and with our agreements with Schools.
We do not sell personal information. We do not use student information for advertising or marketing, and we do not build profiles of students for any purpose unrelated to the School's educational services.
4. Text messaging (SMS)
If you opt in, BCA Attendance Solutions (PresenceIQ) will send you attendance and account notification text messages about your child. Message frequency varies. Message and data rates may apply. Text HELP for help or call (855) 211-6436. Reply STOP to opt out at any time. Consent to receive text messages is not a condition of service.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
We share phone numbers only with the messaging service providers that deliver our texts, and only so they can deliver them. Mobile carriers are not liable for delayed or undelivered messages. See the SMS Program section of our Terms & Conditions for full program terms.
5. Student data, FERPA and New York Education Law § 2-d
When a School shares education records with us, we act as a "school official" with a legitimate educational interest under the Family Educational Rights and Privacy Act (FERPA). That means:
- We use student information only to provide the Services to that School.
- We do not re-disclose student information except as the School authorizes or the law requires.
- The School remains in control of its records.
For New York schools, we comply with New York Education Law § 2-d and its regulations (8 NYCRR Part 121), including the School's Parents' Bill of Rights for Data Privacy and Security and any data privacy agreement we sign with the School.
Parents who want to review or correct their child's education records should contact their child's School. We will help the School respond.
6. How we use AI
PresenceIQ uses artificial intelligence to help school staff spot attendance patterns, suggest supports and draft family outreach. We use AI this way:
- AI output is a tool for trained school staff, not a replacement for their judgment. Decisions about students and families are made by people.
- We share with AI service providers only the minimum information needed for a task, under agreements that limit their use of it.
- We do not allow student information to be used to train AI models for anyone else's benefit.
7. How we share information
We share information only:
- With the School that provided it or that the information relates to.
- With service providers who help us run the Services, such as cloud hosting, database, messaging and email providers. They are contractually required to protect the information and use it only for our Services.
- When required by law, such as a valid subpoena or court order. Where allowed, we will notify the School first.
- In a business transfer, such as a merger or acquisition. Any successor must honor this Privacy Policy and our agreements with Schools.
8. Data security
We use administrative, technical and physical safeguards designed to protect information. These include encryption in transit and at rest, role-based access controls, and limiting access to people who need it. No system is perfectly secure. If a breach affects personal information, we will notify the affected School and others as required by law and our agreements.
9. Data retention and deletion
We keep information only as long as needed to provide the Services or as required by law. When a School's agreement ends, we delete or return that School's student and family information within 90 days, unless the School directs otherwise or the law requires us to keep it. Website inquiries are kept as long as needed to respond and follow up.
10. Your choices and rights
- Text messages: reply STOP at any time to stop receiving texts. Reply START to opt back in.
- Access and correction: parents and guardians may ask their School, or us, to see or correct their contact information.
- Questions or complaints: contact us using the details below. New York parents may also contact the New York State Education Department's Chief Privacy Officer.
11. Children's privacy
Our Services are offered to Schools and to adults. They are not directed to children, and we do not knowingly collect personal information directly from children under 13. Student information comes to us from Schools, which provide any consent required under the Children's Online Privacy Protection Act (COPPA) on behalf of parents for educational use.
12. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated version here with a new "last updated" date. If we make material changes, we will notify Schools, and when appropriate parents, before the changes take effect.
